Terms of Service

These terms are a starting template provided for product setup and should be reviewed by your legal counsel before use.

These Terms of Service ("Terms") govern access to and use of WorkforcePilot, a workforce visibility and productivity analytics service operated by PilotSuite LLC ("WorkforcePilot," "we," "us"). By creating an account or using the service, the organization and its authorized users ("you") agree to these Terms.

1. The service

WorkforcePilot provides software for monitoring and analyzing workforce activity on devices that the customer owns or manages, including live coverage, productivity classification, usage trends, screenshots where enabled, and related reporting. Features may change over time as the product evolves.

2. Customer responsibilities & lawful use

You are responsible for deploying WorkforcePilot only on devices and accounts you are authorized to monitor, and for complying with all applicable laws — including providing any legally required notices to, and obtaining any required consent from, your workforce. You are responsible for the accounts, credentials, and configuration of your organization, and for the security groups and managers you grant access to.

3. Accounts & trials

New organizations may receive a free trial. Continued use after the trial requires an active subscription. You agree to provide accurate account and billing information and to keep it current.

4. Fees & billing

Paid plans are billed per seat through our payment processor (Stripe) on the interval you select. Seat counts may be trued-up to reflect actual monitored usage. Except where required by law, fees are non-refundable. You can manage or cancel your subscription from the billing portal; changes take effect according to your plan.

5. HIPAA & Business Associate Agreement

For customers on the Compliance plan that handle Protected Health Information, a separate HIPAA Business Associate Agreement governs the parties' obligations with respect to that information and is incorporated by reference into these Terms.

6. Acceptable use

You may not use the service to violate the law or the rights of others, to attempt to gain unauthorized access, to interfere with the integrity or performance of the service, or to monitor individuals or devices you are not authorized to monitor.

7. Data & privacy

Our handling of information is described in our Privacy Policy. As between the parties, the customer owns its data; you grant us the rights necessary to operate and provide the service.

8. Disclaimers & limitation of liability

The service is provided "as is" without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, WorkforcePilot will not be liable for indirect, incidental, or consequential damages, and our total liability is limited to the amounts you paid for the service in the twelve months preceding the claim.

9. Termination

Either party may terminate as set out in the applicable order or subscription. We may suspend or terminate access for non-payment or material breach. Upon termination, we will return or delete customer data in accordance with our agreements.
